Owning real estate with another person can become challenging when the co-owners no longer agree on how the property should be used, managed, or disposed of. Whether the property was inherited, purchased jointly, acquired through a divorce or separation, or owned as part of a business relationship, disagreements can prevent the property from being sold, maintained, or fairly enjoyed. Matthew Ettinger Law represents property owners in partition actions throughout Pennsylvania, helping clients protect their ownership interests and resolve disputes involving jointly owned real estate.
A partition action is a legal proceeding that allows one or more co-owners to seek a court-ordered resolution when the parties cannot agree on the future of the property. Depending upon the circumstances, the court may order the property to be physically divided, if practical, or more commonly, direct that the property be sold and the proceeds distributed according to each owner's legal interest after appropriate adjustments are made.
